1. Acceptance of Terms

By using BuilderLane.com (“BuilderLane”, “we”, “us”, or “our”), whether as a guest or registered user, you confirm that you are at least 18 years old (or the age of legal majority in your jurisdiction) and capable of entering into a binding contract. These Terms constitute a legally binding agreement between you (“User” or “you”) and BuilderLane. If you are using the site on behalf of a company or other entity, you represent that you have authority to bind that entity to these Terms. Your use of the site signifies acceptance of these Terms and our other policies.

2. Services Overview

BuilderLane.com is an online platform operating as an intermediary under applicable Indian laws (e.g., Information Technology Act, 2000), providing property and construction services listings. Our services include:

(a) Enabling users to list properties for sale or rent,
(b) Facilitating connections between users and developers, builders, agents, sellers, or landlords,
(c) Providing listings for construction-related services (e.g., contractors, architects, designers), and
(d) Offering informational content (e.g., market trends, guides, tools) to assist in real estate decisions.

We do not own, sell, or lease properties, nor do we provide construction services directly. BuilderLane is not a real estate broker, agent, or party to any transaction. All contracts for sale, rental, or services are strictly between the users involved.

3. User Registration and Accounts

Certain features (e.g., listing properties, contacting sellers) require creating an account. You agree to provide true, accurate, current, and complete information during registration and to maintain the confidentiality of your login credentials. You are responsible for all activities under your account and must notify us immediately at contact@builderlane.com of any unauthorized use or security breach. BuilderLane is not liable for losses arising from your failure to comply with this section. We reserve the right to refuse registration or terminate accounts that violate these Terms or engage in fraudulent/abusive conduct.

4. Listing and Content Guidelines

Users posting content (e.g., property listings, service listings, descriptions, photos, videos, reviews, comments) must adhere to these guidelines:

  • Accuracy: Provide accurate, truthful information about properties or services (e.g., price, location, specifications, availability). Promptly update listings if details change (e.g., property sold, price adjusted). Do not omit or misrepresent critical information.
  • Legality and Compliance: Ensure you have the right to post content. Property listings must comply with applicable laws, including providing valid RERA registration numbers where required. Users must verify RERA compliance directly with developers or official RERA websites, as BuilderLane does not validate RERA registrations. Service providers must hold necessary licenses. Content violating laws (e.g., intellectual property, privacy) is prohibited.
  • Quality and Decorum: Use high-quality images and clear descriptions. Do not post obscene, defamatory, harassing, fraudulent, or objectionable content. Avoid spammy or irrelevant promotional language.
  • No Duplicate Listings: Do not post the same property or service multiple times to skew search results. Reposting is allowed after a reasonable period or for significant updates.
  • Content Moderation: BuilderLane does not guarantee the accuracy of user-generated content (e.g., reviews, feedback) and may moderate or remove content deemed abusive or inaccurate.
  • Rights Granted: By posting content, you grant BuilderLane a non-exclusive, worldwide, royalty-free license to use, reproduce, modify (for formatting/display), and publish your content for our services. This license ends when your content is removed.

BuilderLane reserves the right to refuse, deactivate, or remove any content violating these guidelines or deemed inappropriate, with or without notice.

5. User Obligations and Conduct

You agree to use BuilderLane responsibly and lawfully. You must not:

  • Impersonate or Mislead: Do not impersonate others or misrepresent your identity/affiliation (e.g., posing as a buyer when you’re an agent).
  • Interfere with Others’ Use: Do not disrupt BuilderLane’s functionality or user experience (e.g., hacking, introducing viruses, flooding requests).
  • Data Extraction: Do not use automated tools (e.g., robots, scrapers) to access the site or harvest personal information without our written permission.
  • Unauthorized Commercial Use: Do not use BuilderLane for unapproved commercial purposes (e.g., advertising unrelated products, sending spam).
  • Compliance: Comply with all applicable laws (e.g., RERA, local building codes). Users outside India must ensure compliance with local and export/import laws.

6. Transactions Between Users

BuilderLane facilitates connections, but all transactions (e.g., property sale/rent, service hiring) are solely between the parties involved. We do not negotiate or execute deals. Users are responsible for transaction terms (e.g., pricing, contracts, warranties, payments). We recommend:

  • Buyers verify property documents and seller identity.
  • Sellers verify buyer credentials.
  • Both parties use legal contracts and acknowledge payments.
  • Engage professionals (e.g., lawyers, inspectors) for high-value transactions.

BuilderLane is not liable for disputes, claims, or damages arising from transactions. Report fraudulent behavior to contact@builderlane.com; we may suspend or investigate users but do not mediate disputes.

7. Intellectual Property Rights

BuilderLane’s content (e.g., logo, design, text, graphics, software) is protected by copyright, trademark, and other laws. You are granted a limited, revocable license to access and use site content for personal or internal business purposes related to real estate or construction services. You may not copy, distribute, or create derivative works without permission, except for personal reference (e.g., printing a listing).

  • User Content: You retain ownership of your posted content but grant BuilderLane a license as per Section 4. Ensure you have rights to upload content; you indemnify us for third-party intellectual property claims.
  • Infringement Claims: Notify us of copyright or IP infringement at info@builderlane.com. We may remove infringing content and terminate repeat infringers’ accounts.

8. Privacy and Data Usage

Your use of BuilderLane is governed by our Privacy Policy, which details how we collect, use, and protect your data. By using the site, you consent to such processing. We use industry-standard security measures but acknowledge no system is infallible. We may contact you via email, phone, or SMS regarding your account or transactions, with opt-out options for promotional communications.

9. Disclaimer of Warranties

BuilderLane.com is provided “as is” and “as available,” without warranties, express or implied, as detailed in our General Disclaimer. We do not guarantee:

  • Uninterrupted, error-free, or secure site access.
  • Accuracy, completeness, or usefulness of user-provided information (e.g., listing details).
  • Fitness for a particular purpose, merchantability, or non-infringement.

Materials accessed through BuilderLane are at your own risk. You are responsible for any damage to your system or data loss.

10. Limitation of Liability

To the maximum extent permitted by law, BuilderLane (and its affiliates, officers, directors, employees) is not liable for any direct, indirect, incidental, special, consequential, or exemplary damages arising from your use of the site, including:

  • User content or actions.
  • Transaction outcomes or disputes.
  • Viruses or malicious code.
  • Events beyond our control (e.g., technical failures, natural disasters).

Our total liability, if any, is limited to the amount paid to us in the past six months or INR 5,000, whichever is less. Some jurisdictions may limit these exclusions, in which case liability is restricted to the fullest extent allowed.

11. Indemnification

You agree to indemnify, defend, and hold harmless BuilderLane and its affiliates from any third-party claims, losses, liabilities, or expenses (including legal fees) arising from:

  • Your use of the site.
  • Your violation of these Terms or any law/rights.
  • Content you post (e.g., infringement, defamation).
  • Transactions or disputes with other users.

We may assume defense of any matter subject to indemnification, with your cooperation.

12. Termination and Suspension

BuilderLane may suspend or terminate your account or site access at any time, with or without notice, for violating these Terms or engaging in misconduct (e.g., fraudulent listings). You may delete your account at any time. Upon termination:

  • Your access rights cease, and we may deactivate/delete your account/data.
  • Posted content may be archived or deleted, with backups persisting temporarily.
  • Surviving provisions (e.g., liability, indemnification) remain effective.

13. Governing Law and Jurisdiction

These Terms are governed by Indian laws, without regard to conflict of law provisions. Disputes arising from these Terms or site use are subject to the exclusive jurisdiction of Indian courts. Users outside India are responsible for local law compliance, and BuilderLane does not guarantee the platform’s permissibility in all jurisdictions. We may seek injunctive relief in any jurisdiction to protect our interests.

14. Modifications to Terms

We may modify these Terms at any time, notifying users of material changes via site notice or email (for registered users). The “Last Updated” date indicates changes. Continued use after modifications signifies acceptance. If you disagree with changes, stop using the site.

15. Miscellaneous

  • Entire Agreement: These Terms, the General Disclaimer, Privacy Policy, and other posted policies constitute the entire agreement, superseding prior agreements.
  • No Waiver: Failure to enforce any provision is not a waiver.
  • Severability: Invalid provisions are severed, with remaining provisions effective.
  • Assignment: You may not assign these Terms without our consent; we may assign them in connection with mergers or acquisitions.
